Frequently asked questions

Questions clients ask before a consultation

General information only. The answer for your situation depends on its facts.

Which law governs a succession with assets in several countries?

Under Quebec rules, succession to movable property is generally governed by the law of the deceased’s last domicile, and succession to immovable property by the law of the place where it is located. Other countries may apply different rules, so planning matters.

Will a foreign judgment be enforced in Quebec?

A foreign decision can be recognized and enforced if it meets the conditions of the Civil Code, including that the foreign court had jurisdiction and the decision is final. An application to the Quebec court is required.

Should our contract include a choice-of-law and arbitration clause?

In cross-border contracts, usually yes. Clear clauses on governing law, forum and dispute resolution reduce cost and uncertainty if a dispute arises.
